Terms of Use

Introduction

These Terms of Use ("Terms") govern your use of the WishNote Application ("Application"). By downloading and using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.

Your use of the Application is also subject to Apple's Licensed Application End User License Agreement (the "Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms and the Standard EULA conflict, the Standard EULA governs to the extent required by Apple.

1. License

Bülent Türüdü grants you a limited, personal, non-exclusive, non-transferable license to use the Application solely for your personal, non-commercial purposes, in accordance with the App Store Terms of Service.

You may not:

Copy, modify, or create derivative works of the Application
Distribute, rent, lease, sell, or lend the Application
Reverse engineer, decompile, or attempt to derive the source code, except to the extent this restriction is prohibited by applicable law
Use the Application for any commercial purpose without permission

2. Acceptable Use

You agree to use the Application only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Application.

Prohibited behavior includes:

Using the Application to store or transmit malicious code
Attempting to gain unauthorized access to our systems
Interfering with the normal operation of the Application

3. In-App Purchases and Subscriptions

The Application offers optional purchases to unlock additional features and to support development:

WishNote Pro unlocks weekly statistics & completion tracking, upcoming reminder tracking, deadline tracking, unlimited tags & cross-filtering, unlimited photo gallery, 15 alternative app icons, custom themes, and custom icons & colors. It is available as a one-time purchase, or as a monthly or annual auto-renewing subscription.

Tip Jar offers optional one-time contributions (Small, Medium, Large) to support development. These do not unlock any additional features.

All purchases and subscriptions are processed by Apple through the App Store; we do not process payments
Purchases are optional and are not required to use the core features of the Application
Auto-renewable subscriptions (Annual/Monthly) automatically renew for the same duration and price unless cancelled at least 24 hours before the end of the current period; you can manage or cancel a subscription anytime in your device Settings > [Your Name] > Subscriptions
Because Tip Jar purchases are voluntary contributions, they are non-refundable except where required by law or by Apple's policies
Refund requests for any purchase or subscription are handled by Apple through the App Store, not by us

4. Data Backup and Loss

You are responsible for:

Creating your own backups of your data
Understanding that data loss can occur

We are not responsible for:

Loss of data due to device malfunction
Accidental deletion of wishes
iCloud synchronization failures
Device loss or theft

The Application provides iCloud synchronization as a convenience feature, but we do not guarantee its availability or reliability. Always maintain backups if your data is important to you.

5. Limitation of Liability

                TO THE EXTENT PERMITTED BY LAW:
                We provide the Application "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied
We are not liable for any indirect, incidental, special, or consequential damages
We are not liable for loss of data, lost profits, or business interruption
Our total liability is limited to the amount you paid for the Application or its in-app purchases and subscriptions (if any)

            

Nothing in these Terms limits liability that cannot be limited under applicable law.

6. Third-Party Services

The Application uses Apple's services:

iCloud/CloudKit: Subject to Apple's terms and privacy policy
App Store: Subject to Apple's App Store terms
User Notifications: Subject to the iOS operating system terms

We are not responsible for these third-party services or their availability. You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

7. Modification of Terms

We may update these Terms from time to time. Your continued use of the Application after changes means you accept the new Terms.

8. Termination

We reserve the right to terminate or suspend your access to the Application if you violate these Terms. You may terminate these Terms at any time by ceasing to use and deleting the Application.

9. Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles. This does not deprive you of any mandatory consumer protections available to you under the law of your country of residence.

10. Severability

If any part of these Terms is found to be invalid, the remaining parts continue in effect.

Kullanım Şartları

Giriş

Bu Kullanım Şartları ("Şartlar"), WishNote Uygulaması'nın ("Uygulama") kullanımınızı düzenler. Uygulama'yı indirerek ve kullanarak bu Şartlar'a bağlı olmayı kabul edersiniz. Kabul etmiyorsanız lütfen Uygulama'yı kullanmayın.

Uygulama'yı kullanımınız aynı zamanda https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ adresinde yer alan Apple Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesi'ne ("Standart EULA") tabidir. Bu Şartlar ile Standart EULA çeliştiğinde, Apple'ın gerektirdiği ölçüde Standart EULA geçerli olur.

1. Lisans

Bülent Türüdü, App Store Hizmet Koşulları'na uygun olarak, Uygulama'yı yalnızca kişisel ve ticari olmayan amaçlarınızla kullanmanız için sınırlı, kişisel, münhasır olmayan ve devredilemez bir lisans verir.

Şunları yapamazsınız:

Uygulama'yı kopyalamak, değiştirmek veya türev eserler oluşturmak
Uygulama'yı dağıtmak, kiralamak, satmak veya ödünç vermek
Uygulama'nın kaynak koduna ulaşmaya çalışmak, kodu geri derlemek veya tersine mühendislik yapmak; bu kısıtlamanın yürürlükteki hukuk gereği yasak olduğu ölçüde bu hüküm uygulanmaz
İzin almaksızın Uygulama'yı ticari amaçlarla kullanmak

2. Kabul Edilebilir Kullanım

Uygulama'yı yalnızca yasal amaçlarla ve başkalarının haklarını ihlal etmeyecek ya da onların Uygulama'yı kullanmasını kısıtlamayacak biçimde kullanmayı kabul edersiniz.

Yasaklanan davranışlar:

Uygulama'yı kötü amaçlı kod depolamak veya aktarmak için kullanmak
Sistemlerimize izinsiz erişim elde etmeye çalışmak
Uygulama'nın normal işleyişine müdahale etmek

3. Uygulama İçi Satın Almalar ve Abonelikler

Uygulama, ek özellikleri açmak ve geliştirmeyi desteklemek için isteğe bağlı satın alma seçenekleri sunar:

WishNote Pro; haftalık istatistikler ve tamamlanma takibi, yaklaşan hatırlatıcı takibi, son tarih takibi, sınırsız etiket ve çapraz filtreleme, sınırsız fotoğraf galerisi, 15 alternatif uygulama ikonu, özel temalar ve özel ikon/renkleri açar. Tek seferlik satın alma veya aylık ya da yıllık otomatik yenilenen abonelik olarak sunulur.

Tip Jar (Bahşiş Kutusu), geliştirmeyi desteklemek için isteğe bağlı tek seferlik katkılar (Küçük, Orta, Büyük) sunar. Bunlar herhangi bir ek özellik açmaz.

Tüm satın almalar ve abonelikler Apple tarafından App Store üzerinden işlenir; ödemeleri biz işlemeyiz
Satın almalar isteğe bağlıdır ve Uygulama'nın temel özelliklerini kullanmak için gerekli değildir
Otomatik yenilenen abonelikler (Yıllık/Aylık), mevcut dönemin bitiminden en az 24 saat önce iptal edilmedikçe aynı süre ve fiyatla otomatik olarak yenilenir; aboneliğinizi cihaz Ayarları > [Adınız] > Abonelikler bölümünden istediğiniz zaman yönetebilir veya iptal edebilirsiniz
Tip Jar satın almaları gönüllü katkı niteliğinde olduğundan, yasa veya Apple'ın politikaları gerektirmedikçe iade edilmez
Herhangi bir satın alma veya abonelik için iade talepleri, tarafımızca değil Apple tarafından App Store üzerinden ele alınır

4. Veri Yedekleme ve Kayıp

Siz sorumlusunuz:

Verilerinizin kendi yedeklerini oluşturmaktan
Veri kaybı olabileceğini anlamaktan

Biz sorumlu değiliz:

Cihaz arızası nedeniyle veri kaybından
Dileklerin yanlışlıkla silinmesinden
iCloud senkronizasyonu başarısızlığından
Cihaz kaybı veya hırsızlığından

Uygulama, iCloud senkronizasyonunu bir kolaylık özelliği olarak sunar; ancak kullanılabilirliğini veya güvenilirliğini garanti etmez. Verileriniz sizin için önemliyse her zaman yedek tutun.

5. Sorumluluk Sınırlaması

                YASANIN İZİN VERDİĞİ ÖLÇÜDE:
                Uygulama'yı, açık veya zımni hiçbir garanti vermeksizin "OLDUĞU GİBİ" ve "MEVCUT HÂLİYLE" sağlarız
Dolaylı, tesadüfi, özel veya sonuç niteliğindeki hiçbir zarardan sorumlu değiliz
Veri kaybından, kâr kaybından veya iş aksamasından sorumlu değiliz
Toplam sorumluluğumuz, Uygulama için veya uygulama içi satın almalar ve abonelikler için ödediğiniz tutarla sınırlıdır (varsa)

            

Bu Şartlar'daki hiçbir hüküm, yürürlükteki hukuk uyarınca sınırlandırılamayacak sorumluluğu sınırlamaz.

6. Üçüncü Taraf Hizmetleri

Uygulama, Apple'ın hizmetlerini kullanır:

iCloud/CloudKit: Apple'ın koşullarına ve gizlilik politikasına tabidir
App Store: Apple'ın App Store koşullarına tabidir
Kullanıcı Bildirimleri: iOS işletim sistemi koşullarına tabidir

Bu üçüncü taraf hizmetlerinden veya bunların kullanılabilirliğinden sorumlu değiliz. Apple'ın ve Apple'ın bağlı kuruluşlarının bu Şartlar'ın üçüncü taraf lehdarları olduğunu ve bu Şartlar'ı kabul etmenizle birlikte bunları size karşı uygulama hakkına sahip olacaklarını kabul edersiniz.

7. Şartlarda Değişiklikler

Bu Şartları zaman zaman güncelleyebiliriz. Değişikliklerden sonra Uygulama'yı kullanmaya devam etmeniz, yeni Şartlar'ı kabul ettiğiniz anlamına gelir.

8. Sonlandırma

Bu Şartları ihlal etmeniz hâlinde Uygulama'ya erişiminizi sonlandırma veya askıya alma hakkını saklı tutarız. Siz de Uygulama'yı kullanmayı bırakıp cihazınızdan silerek bu Şartlar'ı istediğiniz zaman sonlandırabilirsiniz.

9. Yürürlükteki Hukuk

Bu Şartlar, hukuk çatışması ilkelerine bakılmaksızın Türkiye yasalarına tabidir. Bu hüküm, ikamet ettiğiniz ülkenin hukuku uyarınca sahip olduğunuz emredici tüketici korumalarından sizi yoksun bırakmaz.

10. Ayrılabilirlik

Bu Şartlar'ın herhangi bir kısmı geçersiz bulunursa, geri kalan kısımlar yürürlükte kalır.
